Judge Janet Neff of the US District Court for Western Michigan turned down Governor Gretchen Whitmer’s request to move the case to state court. In her ruling, she said that “important federal interests at stake” were in keeping the case in federal court.
Michigan has tried to shut down the line by going to court in its state. Whitmer has told Enbridge Inc. (TSE: ENB) to shut down Line 5, saying that it is terrible for the environment where it goes through the Straits of Mackinac, which is where Lake Michigan and Lake Huron meet. Enbridge Inc. (TSE: ENB) has refused to do what the governor wants, saying she is overstepping her authority and that federal law applies.
When asked for a comment, the governor’s office did not respond right away.
